Terms of Service

The rules for using BanterBox, including one-time purchases, permission to share details about other people, AI-generated content, refunds and liability.

1) About these Terms

These Terms govern your use of BanterBox, operated by Tradie Assistant Digital ("we", "us", "our"), including our website, the pack builder, contributor invite links, and the game packs we deliver.

By using BanterBox you agree to these Terms and our Privacy Notice. If you do not agree, do not use the service.

2) Key definitions

  • Service: the BanterBox website, pack builder and delivery pages.
  • Organiser: the person who creates and pays for a pack.
  • Guest of honour: the person the pack is built around.
  • Contributor: someone the organiser invites to add stories through an invite link.
  • Intake details: the information entered about the guest of honour and the event.
  • Pack: the personalised, printable PDF game pack and its delivery page.
  • Games: the game formats we offer, currently Secret Missions, Majority Rules, The Outsider, Bet Your Mate, The Pitch, and Sketchy Business.

3) Eligibility

You must be at least 18 years old to buy a pack or submit a contribution. By using the Service you confirm that you are.

The guest of honour must also be an adult. BanterBox is not for building games about children.

4) How BanterBox works

You enter details about the guest of honour, optionally invite others to add stories, choose your games, and pay. After payment we build the full pack and email it to you, usually within minutes.

We sign you in with a magic link sent to your email rather than a password. Anyone with access to your email inbox, or with your pack link, can reach your pack. Keep both to yourself.

5) Permission to share details about other people

This is the most important obligation in these Terms.

By entering intake details or submitting a contribution, you confirm that:

  • you have the permission you need from the guest of honour and anyone else mentioned, to share those details with us and to have them used in a printed game;
  • the details are accurate to the best of your knowledge and are not defamatory;
  • you are not entering sensitive information, including health, sexual history, financial details, immigration status, religious or political beliefs, or criminal history;
  • you are not entering anything intended to humiliate, harass, threaten, out, or endanger anyone;
  • you have considered that the pack will be read aloud in front of a group.

You are responsible for the details you provide. If a person asks us to remove their information, we will remove it and may delete the pack, without refund where you have breached this section.

6) Acceptable use

Do not use BanterBox to:

  • harass, bully, humiliate, threaten or defame anyone;
  • target anyone on the basis of race, ethnicity, religion, disability, sexual orientation, gender identity or any other protected characteristic;
  • reveal something about a person that they have not chosen to share themselves;
  • create sexual content about any person, or any content involving a minor;
  • break the law, infringe someone's rights, or upload content you do not have the right to use;
  • attack, disrupt, scrape, overload or reverse engineer the Service;
  • resell, sublicense or pass off the Service or our packs as your own product.
  • send invite links to people you do not actually know or who do not know the guest of honour. Do not post an invite link publicly, on social media, or to a group of strangers;
  • enter anyone's identification documents, financial details, passwords, addresses or contact details.

We may refuse, remove or edit content, and suspend or close accounts, where we reasonably believe this section has been breached.

7) Purchases and pricing

  • BanterBox is sold as a one-time purchase. There is no subscription and no recurring charge.
  • Prices are shown in Australian dollars and include tax where applicable. The price you see at checkout is the price you pay.
  • Payment is processed by Stripe. Your bank may apply its own currency conversion or foreign transaction fees, which we do not control.
  • We may change prices at any time, but never for a purchase you have already made.

8) Delivery, and your right to cancel

Your pack is a personalised digital product. We start building it as soon as your payment succeeds, and it usually reaches you within minutes.

If you are a consumer in the EU or the UK, you normally have 14 days to cancel a purchase made online. Two exceptions apply to BanterBox packs: they are made to your specification, and they are digital content that we begin supplying immediately.

At checkout you expressly ask us to begin building your pack straight away, and you acknowledge that once we have begun you lose your right to cancel. We record that request and that acknowledgement, and we confirm both back to you in the email that delivers your pack.

If you have not yet ticked that box, or if we have not started building your pack, you keep the full 14-day right to cancel and we will refund you in full.

How to cancel. If you are entitled to cancel, you do not need to give a reason and you do not need to explain yourself. Email support@banterboxparty.com with your pack link or the email address you bought with. We will confirm we received your request by email, and refund you within 14 days of accepting it.

Nothing in this section affects the rights described in section 9.

9) Refunds

Because packs are personalised and delivered within minutes, we do not offer change-of-mind refunds once your pack has been built.

We will refund you if:

  • you paid but we failed to deliver a pack;
  • the pack we delivered was faulty, unusable, or materially not what was described;
  • you are entitled to a remedy under consumer law.

Australian consumers: nothing in these Terms limits your rights under the Australian Consumer Law. Our goods and services come with guarantees that cannot be excluded. You are entitled to a replacement or refund for a major failure, and to compensation for other reasonably foreseeable loss or damage.

Consumers elsewhere: nothing in these Terms limits any non-excludable rights you have under the consumer law of your own country.

If something has gone wrong, email support@banterboxparty.com and we will sort it out.

10) AI-generated content

BanterBox uses AI to build the games from the details you provide.

  • Output can be imperfect. It may be repetitive, may misread a detail you entered, or may land differently than you expected in the room.
  • You should read your pack before you play it. You know your group. We do not, and we cannot judge how a particular joke will be received.
  • We screen for topics you mark as off limits, but no automated screen is perfect. Reviewing the pack is your responsibility.
  • The Service is for entertainment. Nothing in a pack is advice of any kind.

If your pack is unusable or clearly missed the brief, contact us and we will fix it or refund you.

11) Content and intellectual property

  • We own the BanterBox brand, website, game formats, rules, layouts and templates.
  • You own the intake details and contributions you provide.
  • Your pack: once you have paid, you get a personal licence to your pack that does not expire. You can print it as many times as you like, play it at your event, photograph it, post about it, and share the printed pages with your guests. The details and stories you provided remain yours.
  • The game formats, rules, artwork and layouts remain ours. Your personal licence does not let you sell your pack or its pages, distribute it commercially, use it in a paid or ticketed event, or use our game formats as the basis for a competing product. If you want to use BanterBox commercially, email us and we will talk.
  • Licence to us: you grant us the licence we need to store, process and transform your details to build, deliver, store and let you reprint your pack. We do not use your pack content publicly, and we do not use it for marketing without asking you first.
  • Feedback: if you send us suggestions, we can use them to improve the product without owing you anything.

12) Availability and changes

We may add, change or retire features, including individual games. We will keep packs you have already bought available to download, but we cannot promise a specific game will always be offered to new customers.

The Service may be unavailable during maintenance or incidents, and depends on third-party providers we do not control.

13) Liability

To the fullest extent permitted by law, and subject to section 9:

  • The Service is provided "as is". We do not warrant that it will be uninterrupted, error free, or that generated content will meet your expectations.
  • We are not liable for indirect, special, incidental, punitive or consequential loss, including any loss arising from how a pack was received at your event.
  • Our total liability to you for any claim is capped at the amount you paid us for the pack the claim relates to.
  • Nothing here excludes liability that cannot be excluded by law, including under the Australian Consumer Law, or for fraud, death or personal injury caused by negligence.

14) Indemnity

You agree to indemnify us against claims, damages and reasonable costs arising from your breach of these Terms, in particular section 5 and section 6.

This does not apply to the extent a claim arises from our own breach or negligence.

15) Suspension and termination

You can stop using BanterBox and ask us to delete your account at any time.

We may suspend or close your access if you breach these Terms, misuse the Service, or create risk for other people. Where it is reasonable to do so, we will tell you why and give you a chance to respond. If we close your account for a reason that is not your fault, we will refund any pack you paid for but cannot access.

16) Governing law

These Terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction.

If you are a consumer in another country, this does not deprive you of the protection of mandatory consumer laws in your country of residence, or of the right to bring proceedings there where local law gives you that right.

17) Changes to these Terms

We may update these Terms. We will post the latest version here with the date at the top. For material changes we will email organisers with an active pack. Changes do not apply retrospectively to a purchase you have already made.

18) General

  • Entire agreement: these Terms and the Privacy Notice are the whole agreement between us about the Service.
  • Severability: if part of these Terms is unenforceable, the rest still applies.
  • Assignment: you may not assign these Terms without our consent. We may assign them as part of a business transfer.
  • Waiver: not enforcing a right straight away does not waive it.
  • Force majeure: neither party is liable for delays caused by events beyond reasonable control, including provider outages.
